About
Litigation is a legal term used to characterize divergences between two or more parties, regarding rights, obligations, and interests. In the electricity sector, it is observed that a large part of the disputes is resolved via judicial or arbitration processes. However, there is also a significant volume of controversies resolved in the administrative sphere, especially at the National Electric Energy Agency (ANEEL), through administrative processes of a contentious nature.
What we do
We provide technical assistance in the main types of processes:
Judicial Processes
- Formal procedures conducted by state or federal courts, based on the constitutional principle of access to justice;
- The judge or collegiate body analyzes evidence and arguments, issuing a binding decision for the parties;
- Generally public, with the exception of cases under legal secrecy.
Arbitration Processes
- An alternative dispute resolution mechanism, used when the parties agree to submit the conflict to chosen arbitrators;
- Characterized by confidentiality and the difficulty of contesting decisions in regular courts;
- Offers greater flexibility in relation to judicial processes.
Administrative Processes of a contentious nature
- Disputes between agents of the electric sector and the public administration, conducted within the scope of ANEEL;
- Involve topics such as the application of penalties, tariff review, non-compliance with concession contracts, and regulatory divergences.
